Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Wasatch Back Guide (the “Service”), operated from Heber City, Utah. Please read them carefully.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

• You must provide accurate information when creating an account and keep it up to date.
• You are responsible for maintaining the security of your account and for all activity that occurs under it.
• You must be at least 13 years old to use the Service.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for abuse, fraud, or unlawful purposes.

The Service lets you submit content — including business and event submissions, saved lists, photos, tips, and messages (“User Content”).

• You own your content. You retain all ownership rights in the User Content you submit.
• License to us. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and distribute that content solely to operate, promote, and improve the Service. You can remove your content, and this license ends when you do, except for reasonable backups and content others have already saved or shared.
• Your responsibilities. You represent that you have the rights to submit your User Content and that it does not infringe others’ rights, is accurate, and is not unlawful, misleading, or abusive.
• Moderation. We may review, edit, or remove User Content at our discretion — for example, to correct inaccuracies or remove content that violates these Terms — but we are not obligated to monitor it.

• Business listings may be created from public information, user submissions, or by business owners who claim them. We strive for accuracy but do not guarantee that any listing — including hours, pricing, contact details, or availability — is complete or current.
• If you claim a listing as its owner or authorized representative, you are responsible for the accuracy of the information you provide and for having the authority to manage that listing.
• Paid tiers (such as Partner and Featured) affect placement and available features but do not constitute an endorsement, and pricing and features may change. We’ll give notice of material changes to paid services.
• Listings are informational. Always confirm details directly with a business before relying on them.

You agree not to:

• Post false, misleading, defamatory, or fraudulent content, including fake reviews or listings;
• Violate any law or infringe any third party’s intellectual property, privacy, or other rights;
• Scrape, harvest, or copy the Service or its data without permission;
• Interfere with or disrupt the Service, or attempt to gain unauthorized access to it;
• Use the Service to harass, abuse, or harm others.

The Service — including its design, branding, text, and software, but excluding User Content — is owned by Wasatch Back Guide and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, or create derivative works from the Service without our permission.

The Service may link to third-party websites, businesses, or services we don’t control. We are not responsible for their content, products, or practices, and your dealings with them are solely between you and them.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information (including business listings and recommendations) is accurate or reliable.

To the fullest extent permitted by law, Wasatch Back Guide and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100).

You agree to indemnify and hold harmless Wasatch Back Guide and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Utah will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue there.

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above and, for material changes, provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
